Legal expert Michael McCann notes that the Clippers lack a viable path for appeal, as the players' association and star player Kawhi Leonard accepted the terms of the punishment. The NBA's investigation concluded that the team engaged in cap circumvention by directing funds to Leonard through multiple no-show endorsement deals, breaching the Collective Bargaining Agreement.
Furthermore, McCann points out that courts typically respect the decisions made by private associations like the NBA, intervening only in cases of arbitrary actions. This legal context suggests that the NBA is likely to prevail if the Clippers proceed with a lawsuit, which could further alienate Ballmer and the franchise.
