Emmitt Smith Faces Lawsuit Over Alleged $2.5 Million Fraud
Emmitt Smith, a Pro Football Hall of Fame running back and three-time Super Bowl champion, is facing a lawsuit that claims he and his commercial real estate firm cheated a Native American investor out of $2.5 million. The lawsuit was filed in Delaware's Chancery Court and seeks the return of the loan plus interest.
The complaint alleges that Smith, his business partner David Mosley, and their company, 4 13 Solutions Inc., convinced Kituwah LLC to invest in a Texas solar project named Project Exodus. Kituwah, representing the Eastern Band of Cherokee Indians, claims the funds were misappropriated to repay another company, Wilson Holdings, rather than being used for the intended project.
Kituwah asserts that Smith and Mosley misled them about the investment's purpose and falsely indicated that other investors were interested. The lawsuit states that the loan was due by February 1, 2024, but remains unpaid, with Kituwah reporting no recovery of the funds. Attempts to reach 4 13 Solutions for comment were unsuccessful.
