High Court Allows Rugby Concussion Cases to Proceed
The High Court has ruled that legal actions involving hundreds of rugby players concerning concussion claims can proceed. This decision follows a lengthy legal battle that began in 2020, with the court allowing nearly 500 players from both rugby union and league to continue their claims against the sport's governing bodies.
Senior Master Jeremy David Cook made the ruling after a change in legal representation for the players, who allege that the governing bodies failed to implement adequate safety measures to protect them from repeated head injuries. The governing bodies, including World Rugby and the Rugby Football Union, deny any breach of duty regarding player safety.
While the judge expressed hesitation about allowing the claims to proceed, he acknowledged the exceptional circumstances of the case and its potential public importance. The court has mandated that the players disclose medical records and neuropsychological assessments to the governing bodies, with further hearings to determine conditions for the trial.
