Lawsuit Filed Against Cardinals and Owner for Racial Discrimination
Two former employees of the Arizona Cardinals, Kendra Hogue and Don Shumpert, have initiated a lawsuit in Arizona state court against the team and owner Michael Bidwill, citing racial discrimination, retaliation, defamation, and constructive termination. This legal action was filed on May 26, coinciding with the team setting a franchise record for consecutive home losses.
The case was transferred to federal court on June 1, and on September 19, it was directed to arbitration by federal judge John Hinderaker, who appointed an arbitrator. This situation raises questions about the NFL's use of arbitration clauses, which have faced increasing scrutiny regarding their fairness.
The plaintiffs may benefit from the legal environment in Arizona, which is under the jurisdiction of the Ninth Circuit Court of Appeals, known for its pro-worker rulings. This context could influence the outcome of the case, similar to the Brian Flores lawsuit, which also involved the Cardinals.
